Terms of Service

These Terms of Service ("Terms") govern your use of School Gradebook ("the Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a school or organisation, you confirm you are authorised to do so.
1. The Service
School Gradebook provides web-based tools for schools and homeschool families to record grades and attendance, produce report cards and certificates, keep a calendar, and communicate with parents. We may add, change, or remove features over time to improve the Service.
2. Accounts and eligibility
- Accounts are created for and by responsible adults — school administrators, teachers, secretaries, and parents. Students do not have accounts.
- You are responsible for keeping your password confidential and for activity that happens under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly if you believe your account has been accessed without permission.
3. Your data and ownership
The information a school or family enters — including student records — belongs to that school or family. We do not claim ownership of it. You grant us the limited permission needed to store, process, and display that information in order to provide the Service. Our handling of information is described in our Privacy Policy.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or to store information you are not permitted to hold;
- attempt to access another school's or family's data, or any account that is not yours;
- disrupt, probe, or attempt to break the security of the Service;
- upload malicious code, or misuse messaging features to send spam or harmful content;
- resell or provide the Service to third parties except as agreed with us.
5. Fees and subscriptions
Paid plans are billed on an annual basis at the price applicable to your plan. Plans and prices shown on our website may change; any change will apply from your next renewal. Unless required by law or otherwise stated, fees already paid are non-refundable. If a school is suspended for non-payment, its users may be unable to sign in until the balance is resolved.
6. Availability, backups, and changes
We work to keep the Service available and reliable, and we take automatic backups, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and we may modify or discontinue parts of the Service; where a change is significant, we will make reasonable efforts to notify account owners.
7. Termination
You may stop using the Service at any time. We may suspend or end access if these Terms are breached, if payment is not made, or if we must do so to protect the Service or other users. On termination, you may request an export of your data, and we will handle remaining data in line with our Privacy Policy and any legal obligations.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. You are responsible for reviewing the accuracy of grades, report cards, and other records the Service produces from the information you enter.
9. Limitation of liability
To the fullest extent permitted by law, School Gradebook will not be liable for indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the claim.
10. Changes to these Terms
We may update these Terms from time to time. When we make a significant change, we will update the "last updated" date above and, where appropriate, notify account owners. Continued use of the Service after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. You agree that the state and federal courts located in Colorado have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms or your use of the Service, regardless of where you or your school are located.
